Terms of Service
Effective 27 August 2026
These terms are an agreement between you and Weaveflow LLC, a Wyoming limited liability company.
They govern AskInstead, its websites, applications, conversations, and related services. We call these services the “Service.”
By creating an account or using the Service, you agree to these terms.
1. Eligibility and accounts
You must be at least 18 years old and able to enter a binding agreement.
You must provide accurate account details. Keep your credentials secure and tell us about unauthorized access.
Each team member needs a separate account. An organization owner controls billing and team access.
2. Limited trial
AskInstead has no permanent free plan. An eligible organization can receive one limited trial.
The trial starts after the first conversation publishes. It lasts seven days and requires no payment card.
The trial includes 10 completed responses, 10 voice minutes, one published conversation, and one concurrent session.
One trial applies to each organization and email mailbox. Address variations for one mailbox count as the same mailbox.
A disposable email service cannot start a trial. We can refuse trial access when we detect abuse.
3. Plans, renewal, and cancellation
Paid plans renew monthly until canceled. The current price and included usage appear before purchase.
Cancel before renewal to stop the next charge. Cancellation takes effect at the end of the current billing period.
An upgrade starts after Stripe confirms payment. A downgrade starts at the next renewal.
If payment fails, conversations continue for seven days. They pause after that period until payment succeeds.
4. Usage limits and top-ups
A completed response is one recipient’s finished voice or text conversation.
Voice minutes measure total voice time. Text responses use no voice minutes.
Included usage resets at monthly renewal and does not carry forward. Active subscribers can buy separate top-ups.
We can enforce limits, session duration, concurrency, provider cost, and reasonable abuse controls.
5. Your content
You keep ownership of prompts, questions, answers, recordings, transcripts, fields, and other content you provide.
You grant Weaveflow LLC the limited rights needed to store, process, transmit, and return that content.
You must have the rights and permissions needed for all content and recipients you place in the Service.
6. AI output
AskInstead uses automated systems to draft questions, ask follow-ups, summarize answers, and extract fields.
AI output can contain errors or omit details. You must review results before important decisions.
Do not use AskInstead as the only basis for medical, legal, financial, employment, housing, or safety decisions.
7. Recording and recipient consent
You must use lawful questions and obtain all permissions required for each recipient and recording.
AskInstead shows a notice before recorded voice starts. That notice does not replace your legal duties.
Read the Consent and Recording Policy before you send a conversation.
8. Acceptable use
- Do not use the Service for unlawful, deceptive, abusive, discriminatory, or rights-infringing activity.
- Do not collect information that you have no lawful reason to request.
- Do not send spam or misrepresent who created a conversation.
- Do not probe, disrupt, overload, reverse engineer, or bypass Service limits.
- Do not upload malware or use answers to harm a recipient.
9. Suspension and refunds
We can suspend access for misuse, nonpayment, fraud warnings, chargebacks, or a material breach of these terms.
There is no general money-back guarantee. The Refund Policy explains available exceptions.
10. Service changes
We can change features, providers, limits, or availability. We will give reasonable notice for material paid-plan changes.
We do not promise uninterrupted access. Third-party providers can affect voice, email, payment, and AI availability.
11. Intellectual property
AskInstead software, branding, and site content belong to Weaveflow LLC and its licensors.
These terms do not grant rights to our trademarks or software, except the right to use the Service.
12. Warranty disclaimer
The Service is provided “as is” and “as available,” to the maximum extent permitted by law.
We disclaim implied warranties, including merchantability, fitness for a purpose, and non-infringement.
13. Limitation of liability
Weaveflow LLC is not liable for indirect, incidental, special, consequential, or punitive damages where law permits.
Our total liability is limited to the amount you paid for AskInstead during the three months before the claim.
Some laws do not allow these limits. In that case, the limits apply only as far as permitted.
14. Termination
You can stop using AskInstead at any time. We can close an account that breaches these terms.
Stored data remains subject to the applicable retention schedule and legal record duties.
15. Governing law
Wyoming law governs these terms, without regard to conflict-of-law rules.
State and federal courts located in Wyoming have exclusive jurisdiction, unless applicable law requires another forum.
16. Changes and contact
We can update these terms. We will post the new effective date and give notice when required.
